This case involved a wrongful death action brought under the Federal Employers Liability Act, 45 U.S.C. § 51 et seq., for the death of the plaintiffs decedent who was killed in the line of his duties while working for the defendant railroad. The issues of the defendants negligence, the decedents contributory negligence, and damages were submitted to the jury. A verdict was returned for the defendant railroad and a judgment was entered thereon. The plaintiffs motion for a new trial was denied and this appeal followed. We must view the facts in the light most favorable to support that judgment.
